General information


INEA is an Executive Agency established by the European Commission to implement parts of EU funding programmes for transport, energy and telecommunications:
 The Connecting Europe Facility (CEF): a key EU funding instrument supporting the development of high-performing, sustainable and interconnected Trans-European Networks in the fields of transport, energy and telecommunications.
 Horizon 2020: the EU's Research and Innovation programme supporting world-class science and technology. INEA is managing parts of the programme in the areas of transport and energy.
The Agency also manages a number of legacy projects supported by the TEN-T and Marco Polo programmes.
INEA's mission is to provide its stakeholders with expertise and high-level programme management, whilst promoting synergies among programmes, in order to benefit economic growth and EU citizens.

Working environment
INEA has a multinational team of over 230 specialists in project management, finance, and engineering covering the fields of transport, energy and telecommunications.
The number of INEA staff is expected to grow significantly over the coming years. The purpose of this publication is therefore to set up a reserve list which will be used to cover these growing needs of the Agency.

Legal - Legal Adviser

Position title

Mission description

The Legal Adviser shall work for the Legal team of the Agency. The Legal team is responsible for providing legal counsel and advice on issues related to the financing and administrative management of the Programmes it is implementing (TEN-T and Marco Polo Legacy programmes, CEF and Part III Societal Challenges of the Horizon 2020 Specific Programme) and their projects, as well as on issues related to the regulatory and institutional aspects regarding internal and procurement procedures within the Agency. The Legal Adviser shall work autonomously under the authority of the Head of Legal Team, and also coordinate his/her work with that of the other legal advisers. S/he shall also work closely and collaborate fully with a wider team of colleagues from the Agency, the European Commission and other Union Institutions and bodies as necessary. More specifically s/he will be responsible and/or contribute to the following tasks:

Tasks (1/2):

1. Legal analysis, advice and assistance related to internal matters within the Agency
 Contribute to the approach taken on legal issues and ensure compliance with existing rules, regulations and applicable legal basis.
 Supervise the Agency's procurement procedures and contracts.
 Contribute to the production of manuals for management and units on legal and procedural issues. Prepare replies to requests for advice and / or legal interpretation in support of the preparation and implementation of Union legislation.

Tasks (2/2):
2. Legal support to the implementation of the TEN-T and Marco Polo Legacy programmes, as well as of CEF and Part III Societal Challenges of the Horizon 2020 Specific Programme
 Provide advice on legal issues linked to the abovementioned programmes, analyse and draft synthesis notes, documents and / or briefings on legal issues in close collaboration with all concerned colleagues and parties.
 Provide assistance and advice related directly to the selection of proposals submitted under the different calls for proposals and projects managed within the Agency, including the legal validation of grant agreements and their amendments and legal questions arising in relation to their implementation and interpretation.
 Advice in the drafting, interpretation and application of the work programmes, calls for proposals, and guide for applicants as well as queries during the evaluation of proposals.
 Participate in meetings, working groups and task forces with EU institutions, Member States and other bodies to represent the Agency.
3. Provide legal advice on compliance with EU Law on public procurement
 Legal assessment of the compliance of projects and project proposals with EU Law on public procurement.
4. Reporting of programmes/projects
 Contribute together with the other members of the team to the preparation of replies to questions from the Agency, parent DGs, Member State authorities, European institutions and the general public on general legal, regulatory and institutional matters.
 Contribute to the Agency's internal and external progress reports, as well as to the dissemination of best practices to all concerned parties, via appropriate means of communication (presentations, articles, workshops, seminars, publications, etc).
 Provide assistance to national, regional or local authorities as required.
 Assist in the collection and review as required of the necessary information for audit and control by the Agency, the Commission services or the European Court of Auditors and analyse legal aspects of corresponding reports.
5. Effective participation and contribution to team work
 Under the leadership of the Head of Legal Team and the Head of Unit, carry out his/her tasks in a timely and effective manner and work together with the operational colleagues to support the mission and priorities of the Unit and the Agency.
 Contribute to the definition of the Unit's overall strategic objectives, work programme and specific objectives of the legal team.
 Maintain effective communication and share information with the Unit members, ensuring that they are all aware and regularly informed on all developments related to their work and performance.
 Contribute and adhere to the promotion of the respect of norms, codes of conduct, procedures and control standards.

Selection procedure

A - Written tests (30 min)

A case study in English designed to test:
• Your knowledge in the field of the profile
• Your ability to understand, analyse and summarise
• Your drafting ability
This test will be marked out of 40 (pass mark: 20).
Total time allowed for this test: 30 minutes.
B – Oral test (30 min)
Interview with the Selection Committee in English to assess:
• Your suitability to carry out the duties of a Legal Adviser
• Your specialist knowledge in the Legal domain
• Your communication, inter-personal and problem-solving skills
• Your general knowledge about the INEA and related policies
• Your motivation and ability to adjust to working as a contract agent in a multicultural environment
This test will be marked out of 100 (pass mark: 50).
Both the oral and written tests will be combined on a total of 140. Minimum mark: 84 out of 140.
Applicants receiving the minimum score and above (84 out 140), all tests combined, will be included in a reserve list of suitable candidates. Please note that inclusion in the reserve list does not guarantee recruitment.

Appointment and conditions of employment

The jobholder will be assigned on the basis of a shortlist proposed by the selection committee. The jobholder will be recruited as contract agent, in function group IV, pursuant to Article 3a of the Conditions of Employment of Other Servants of the European Communities (CEOS).
The basic monthly salary within this function group will depend on the number of years of relevant professional experience at appropriate level (in function group IV, either grade 13, grade 14 or grade 16).
The jobholder will serve a probation period of nine months.
The initial contract will be for a duration of 2 years and may be renewed.
The place of employment will be Brussels where the Agency has its activities.

A. Eligibility criteria
 Be owner of a CAST established before 2017 in the grade for which you are applying* or be registered in the EPSO/CAST/P/15/2017
 A level of education which corresponds to completed university studies of at least three years attested by a diploma or, When in a member state of the European Union access to a profession of an equivalent level to function group IV is by State examination, professional training or any other equivalent procedure, the authority authorised to conclude contract of employment may agree to recognise this qualification as being equivalent to a university degree
 Thorough knowledge of one of the languages of the Communities and a satisfactory knowledge of another EU language to the extent necessary to perform his/her duties
*Candidates must be included in the European Personnel Selection Office (EPSO) data base for contract agents in function group IV in a field appropriate to the profile of the post and have successfully passed the EPSO selection tests for that function group or having successfully passed a competition that has been certified by EPSO.
Please note that candidates who are on a valid EPSO list published in 2010 (CAST2010) are eligible on the condition they have successfully passed the complementary tests (DB3), as an Annex to the selection procedure CAST2010. These candidates should consult the letter they received from EPSO for further information.

In addition, in order to be eligible a candidate must:
 be a national of one of the Member States of the European Union;
 be entitled to his or her full rights as citizen;
 meet the appropriate character reference as to his/her suitability for the performance of his/her duties;
 have fulfilled any obligations imposed by the applicable laws concerning military service, and;
 be physically fit to perform the duties linked to the post.

Selection criteria

 A level of education which corresponds to completed university studies in law
 Professional experience acquired in positions related to the profile of the post.
 Experience of complex contract negotiations and enforcement.
 Good knowledge of the legal and institutional framework of the European Union, including EU policies, the EU Financial Regulation and its Rules of Application.
 Very good command of English in the technical fields concerned.
 Experience of working in a multi-cultural and international environment.

 Good knowledge of the H2020 or the CEF regulatory framework
 A specialisation and/or equivalent professional experience on European Union procurement rules.
 Excellent knowledge of at least one of the two other Commission working languages (French and/or German).

Personal qualities essential for the position (evaluated during the interview):
 High degree of organisational skills and ability to work under pressure.
 Good interpersonal and communication skills.
 Proven ability to work as a team member.
 Ability to appreciate and follow priorities.

The Agency will invite to the interview and test phase the best candidates, having already successfully passed an EPSO CAST competition or having successfully passed the EPSO CAST competition EPSO/CAST/P/15/2017, with an estimated number of 10 candidates invited to the interview.
